Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the ARIA website and messaging service (the “Service”), operated by Siddharth Kedharnath, doing business as ARIA (“ARIA”, “we”, “us”, or “our”). By using the Service, you agree to these Terms.
1. Description of Service
ARIA provides appointment reminders, booking confirmations, and review-request text messaging for local appointment-based businesses such as barbershops and salons (“business customers”). ARIA sends SMS messages on behalf of business customers to their own opted-in clients. ARIA does not sell products or services directly to the end recipients of these messages.
2. Eligibility
The Service is intended for use by business owners and operators who are at least 18 years old and have the authority to enter into these Terms on behalf of their business.
3. Business Customer Responsibilities
Business customers using ARIA agree that they will:
- Only submit phone numbers of individuals who have affirmatively opted in to receive text messages from that business.
- Maintain accurate records of consent and honor opt-out requests they receive directly.
- Use the Service only for its intended purpose of appointment reminders, booking confirmations, and review requests, and not for unsolicited marketing, spam, or any unlawful purpose.
- Comply with all applicable laws and carrier requirements regarding SMS messaging, including the Telephone Consumer Protection Act (TCPA).
4. Acceptable Use
You agree not to use the Service to:
- Send messages to recipients who have not opted in.
- Send unlawful, harassing, deceptive, or abusive content.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying infrastructure.
- Misrepresent your identity or the identity of the business on whose behalf a message is sent.
Violation of this section may result in immediate suspension or termination of access to the Service.
5. Message Frequency and Charges
Message frequency varies based on a recipient’s appointment activity with a given business customer. Message and data rates may apply as charged by the recipient’s mobile carrier. Recipients may reply STOP to unsubscribe at any time and HELP for assistance.
6. Intellectual Property
All content, trademarks, and technology associated with the Service are the property of Siddharth Kedharnath / ARIA or its licensors. Nothing in these Terms grants you any right to use our trademarks or branding without prior written permission.
7. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that message delivery will be uninterrupted, timely, or error-free, as delivery depends in part on third-party carriers outside our control.
8. Limitation of Liability
To the fullest extent permitted by law, Siddharth Kedharnath and ARIA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability arising out of or related to these Terms or the Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
9. Indemnification
You agree to indemnify and hold harmless Siddharth Kedharnath and ARIA from any claims, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party right, including claims arising from messages sent to recipients without proper consent.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, us, or third parties.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of such courts.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
